The same document states that the CSSF (Commission de surveillance du secteur financier) supervises Banking Circle as “a credit institution under point (1) of Article 4(1) of Regulation (EU) No 575/2013”. eurostablecoins.xyz records these as Issuer-document facts.

ESMA’s interim MiCA EMT White Paper register independently confirms the EMT notification and the Credit-institution classification: Banking Circle S.A. is listed with LEI 213800W1NGBLERUS6M39, CSSF as competent authority, notification date 29/10/2019, and the EURI whitepaper URL on the register [S4]. The register specifically classifies Banking Circle as a Credit institution, not as an EMI — an important distinction from most other tracked MiCA EMT issuers.

CSSF operates a public supervised-entities register. A direct CSSF register-entry URL specifically for Banking Circle S.A. has not been verified at audit time. ESMA’s interim MiCA EMT White Paper register lists Banking Circle S.A. as a Credit institution with the EURI EMT white paper notified to the CSSF on 29/10/2019 [S4]. The Credit-institution classification (under EU Regulation 575/2013) is materially different from the EMI classification that applies to most other tracked MiCA EMT issuers. EU credit institutions can issue EMTs under MiCA without the Article 48 EMI authorisation pathway because they are already authorised under the Capital Requirements Regulation.

The EURI MiCA white paper describes the safeguarding model: “All customer funds that are received by Banking Circle as fiat currency for the purchase of the EURI, will be segregated in another account, separate from Banking Circle’s own assets” and held “in cash and/or low risk cash equivalents in a bankruptcy remote structure” [S1]. The same document records the statutory redemption right at par value within five Business Days.
